so...

The warrenty company turned down the claim because the transmission fluid leak was there when I purchased the car. So I called my dealer and they ADMITTED knowing that it had a transmission leak. They are towing it down to their dealership to replace the transmission there.

So... the car had no catalitic converter, they admitted knowing that...

it had a transmission leak... they admitted knowing that as well...

It's a used car which will not fall under the 'lemon law' in Georgia however I have contacted a lawyer to talk to about sales fruad.

That is pretty fucked up to say the least. I'm glad you are seeking legal action. Maybe, just maybe, it might prevent them (or at the very least they'll think twice) from doing the same to another unsuspecting customer in the future.

It is VERY illeagel to knowingly sell a car that has had the emmsions altered without disclosure or repair. This is FEDERAL law.

Who did you buy it form? Tell me it wasing IMS on canton? thos guys are criminals and roll odometer.

If the car was purchased with a warranty, and not AS IS, then one side or the other must fix, unless a disclosure was made about the catalytic converter and transmission leak. If you got it AS-IS, then you're screwed. In Georgia there is no such thing as sales fraud with used cars -- they are allowed to say that it belches out chocolate cake, and if you buy it that's your own issue.

The thing is this was supposed to be a 'ford certified preowned' car. Meaning they told me they went over the entire car and fixed the problems. so something like the catilytic converter 'missing' should have been fixed. By purchacing under this policy I was told that the car was in good repair, this was a false representation of the ACTUAL status of the car.

'Certified' legally means jack shit. Its fake fancy language to sell cars. Its about as legally anything as saying the car is 'zesty' or 'funkadelic'.

Dwivian is right. They can lie thru their teeth and they cant be held accountable. You should listen to Clark Howard more...

Certified legally means whatever their certification process means. If they show that they checked things like "the exhaust system" and checked it off, while missing that the catalytic converter was bypassed and removed.... that's a big deal.

Yah, if they failed to disclose, that dealership owes you a lot of work, plus the rental car costs....

They are paying for the rental and the repair costs... but what else is broken on the car? when the transmission went out did it break anything else?

I'm just not sure I want this car any longer.

I know a few folks are asking what dealer did this to you, but I would personally advise against mentioning them "by name" online here or anywhere at least until your dispute is 100% resolved. I'd hate to see you get hosed out of an otherwise winnable scenario by being accused of slander/etc.
